1 A bill to be entitled
2 An act relating to murder; amending s. 782.04, F.S.;
3 revising the elements that constitute the felony
4 offense of murder in the third degree; providing an
5 effective date.

7 Be It Enacted by the Legislature of the State of Florida:
8
9 Section 1. Subsection (4) of section 782.04, Florida
10 Statutes, is amended to read:
11 782.04 Murder.—
12 (4) The unlawful killing of a human being, when perpetrated
13 without any design to effect death, by a person engaged in the
14 perpetration of, or in the attempt to perpetrate, any felony
15 other than any:
16 (a) Trafficking offense prohibited by s. 893.135(1),
17 (b) Arson,
18 (c) Sexual battery,
19 (d) Robbery,
20 (e) Burglary,
21 (f) Kidnapping,
22 (g) Escape,
23 (h) Aggravated child abuse,
24 (i) Aggravated abuse of an elderly person or disabled
25 adult,
26 (j) Aircraft piracy,
27 (k) Unlawful throwing, placing, or discharging of a
28 destructive device or bomb,
29 (l) Unlawful distribution of any substance listed in sub
30 subparagraphs (1)(a)3.a.-j. by a person 18 years of age or
31 older, when such substance is proven to have caused, or is
32 proven to have been a substantial factor in producing, the death
33 of the user,
34 (m) Carjacking,
35 (n) Home-invasion robbery,
36 (o) Aggravated stalking,
37 (p) Murder of another human being,
38 (q) Aggravated fleeing or eluding with serious bodily
39 injury or death,
40 (r) Resisting an officer with violence to his or her
41 person, or
42 (s) Felony that is an act of terrorism or is in furtherance
43 of an act of terrorism, including a felony under s. 775.30, s.
44 775.32, s. 775.33, s. 775.34, or s. 775.35,
45
46 is murder in the third degree and constitutes a felony of the
47 second degree, punishable as provided in s. 775.082, s. 775.083,
48 or s. 775.084.
49 Section 2. This act shall take effect July 1, 2025.
