The Committee on Fiscal Policy (Martin) recommended the
following:
1 Senate Amendment (with title amendment)

3 Delete lines 160 - 182
4 and insert:
5 Section 8. Section 782.072, Florida Statutes, is amended to
6 read:
7 782.072 Vessel homicide.—“Vessel homicide” is the killing
8 of a human being, including the death of an unborn child caused
9 by injury to the mother, by the operation of a vessel as defined
10 in s. 327.02 by another in a reckless manner likely to cause the
11 death of, or great bodily harm to, another. Vessel homicide is:
12 (1) A felony of the second degree, punishable as provided
13 in s. 775.082, s. 775.083, or s. 775.084.
14 (2) A felony of the first degree, punishable as provided in
15 s. 775.082, s. 775.083, or s. 775.084, if:
16 (a) At the time of the accident, the person knew, or should
17 have known, that the accident occurred; and
18 (b) The person failed to give information and render aid as
19 required by s. 327.30(1).
20 (3) As used in this section, the term “unborn child” has
21 the same meaning as in s. 775.021(5)(e).

23 This subsection does not require that the person knew that the
24 accident resulted in injury or death.
25 Section 9. Subsection (2) of section 327.395, Florida
26 Statutes, is amended to read:
27 327.395 Boating safety education.—
28 (2) While operating a vessel, a person identified under
29 subsection (1) must have in his or her possession aboard the
30 vessel photographic identification and a Florida boating safety
31 identification card issued by the commission; a state-issued
32 identification card or driver license indicating possession of
33 the Florida boating safety identification card; or photographic
34 identification and a temporary certificate issued or approved by
35 the commission, an International Certificate of Competency, a
36 boating safety card or certificate from another state or United
37 States territory, or a Canadian Pleasure Craft Operator Card,
38 which shows that he or she has:
39 (a) Completed a commission-approved boating safety
40 education course that meets the minimum requirements established
41 by the National Association of State Boating Law Administrators
42 interactive course standards;
43 (b) Passed a temporary certificate examination developed or
44 approved by the commission;
45 (c) A valid International Certificate of Competency; or
46 (d) Completed a boating safety education course or
47 equivalency examination in another state, a United States
48 territory, or Canada which meets or exceeds the minimum
49 requirements established by the National Association of State
50 Boating Law Administrators.

53 And the title is amended as follows:
54 Delete lines 17 - 18
55 and insert:
56 782.072, F.S.; revising the elements of vessel
57 homicide; defining the term “unborn child”; amending
58 s. 327.395, F.S.; revising the information that must
59 be on certain identification cards and certificates
60 that certain persons are required to have in their
61 possession while operating a vessel;
