The Committee on Fiscal Policy (Martin) recommended the
following:

5 and insert:
6 Section 8. Section 782.072, Florida Statutes, is amended to
7 read:
8 782.072 Vessel homicide.—“Vessel homicide” is the killing
9 of a human being, including the death of an unborn child caused
10 by injury to the mother, by the operation of a vessel as defined
11 in s. 327.02 by another in a reckless manner likely to cause the
12 death of, or great bodily harm to, another. Vessel homicide is:
13 (1) A felony of the second degree, punishable as provided
14 in s. 775.082, s. 775.083, or s. 775.084.
15 (2) A felony of the first degree, punishable as provided in
16 s. 775.082, s. 775.083, or s. 775.084, if:
17 (a) At the time of the accident, the person knew, or should
18 have known, that the accident occurred; and
19 (b) The person failed to give information and render aid as
20 required by s. 327.30(1).

22 This subsection does not require that the person knew that the
23 accident resulted in injury or death.
24 (3) As used in this section, the term “unborn child” has
25 the same meaning as in s. 775.021(5)(e).
26 Section 9. Subsection (2) of section 327.395, Florida
27 Statutes, is amended to read:
28 327.395 Boating safety education.—
29 (2) While operating a vessel, a person identified under
30 subsection (1) must have in his or her possession aboard the
31 vessel photographic identification and a Florida boating safety
32 identification card issued by the commission; a state-issued
33 identification card or driver license indicating possession of
34 the Florida boating safety identification card; or photographic
35 identification and a temporary certificate issued or approved by
36 the commission, an International Certificate of Competency, a
37 boating safety card or certificate from another state or United
38 States territory, or a Canadian Pleasure Craft Operator Card,
39 which shows that he or she has:
40 (a) Completed a commission-approved boating safety
41 education course that meets the minimum requirements established
42 by the National Association of State Boating Law Administrators
43 interactive course standards;
44 (b) Passed a temporary certificate examination developed or
45 approved by the commission;
46 (c) A valid International Certificate of Competency; or
47 (d) Completed a boating safety education course or
48 equivalency examination in another state, a United States
49 territory, or Canada which meets or exceeds the minimum
50 requirements established by the National Association of State
51 Boating Law Administrators.

56 Delete lines 17 - 18
57 and insert:
58 782.072, F.S.; revising the elements of vessel
59 homicide; defining the term “unborn child”; amending
60 s. 327.395, F.S.; revising the information that must
61 be on certain identification cards and certificates
62 that certain persons are required to have in their
63 possession while operating a vessel;
