Subsection (1), paragraph (a) of subsection 12 (10), and subsection (11) of section 893.1495, Florida Statutes, 13 are amended, to read: 14 893.1495 Retail sale of ephedrine and related compounds.— 15 (1) As used inFor purposes ofthis section, the term: 16 (a) “Administrator of the electronic recordkeeping system” 17 means the entity responsible for developing, implementing, and 18 maintaining the electronic recordkeeping system approved by the 19 Department of Law Enforcement under paragraph (5)(b). 20 (b) “Covered entity” means a manufacturer of ephedrine or 21 related compounds sold within or into this state. 22 (c) “Ephedrine or related compounds” means ephedrine, 23 pseudoephedrine, phenylpropanolamine, or any of their salts, 24 optical isomers, or salts of optical isomers. 25 (10) This section does not apply to: 26 (a) Licensed manufacturers manufacturing and lawfully 27 distributing products in the channels of commerce, except that 28 manufacturers that qualify as covered entities are subject to 29 the requirements in paragraph (5)(d). 30 (11) A personAny individualwho violates subsection (2), 31 subsection (3),orsubsection (4), or paragraph (5)(d) commits: 32 (a) For a first offense, a misdemeanor of the second 33 degree, punishable as provided in s. 775.083. 34 (b) For a second offense, a misdemeanor of the first 35 degree, punishable as provided in s. 775.082 or s. 775.083. 36 (c) For a third or subsequent offense, a felony of the 37 third degree, punishable as provided in s. 775.082, s. 775.083, 38 or s. 775.084. 39 Section 2. This act shall take effect July 1, 2025, but 40 only if SB 642 or similar legislation is adopted in the same 41 legislative session or an extension thereof and becomes a law.
