    1                        A bill to be entitled                      
    2         An act relating to fees; amending s. 893.1495, F.S.;
    3         requiring all covered entities, beginning on a
    4         specified date, to pay specified fees to the
    5         administrator of the electronic recordkeeping system
    6         on a monthly basis; specifying that the administrator
    7         is responsible for setting the fees; requiring covered
    8         entities to provide certain written documentation to
    9         the Department of Law Enforcement upon the
   10         department’s request; specifying that failure to pay
   11         the fees subjects the covered entity to certain
   12         criminal penalties; providing a contingent effective
   13         date.

   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Paragraph (d) is added to subsection (5) of
   18  section 893.1495, Florida Statutes, as amended in SB 640, 2025
   19  Regular Session, to read:
   20         893.1495 Retail sale of ephedrine and related compounds.—
   21         (5)
   22         (d)1.Beginning on July 1, 2025, all covered entities must
   23  pay on a monthly basis any fees to the administrator of the
   24  electronic recordkeeping system for the purpose of supporting
   25  the operation of that system in this state.
   26         2.The administrator of the electronic recordkeeping system
   27  is responsible for setting the fees required for each covered
   28  entity under subparagraph 1.
   29         3.Upon the Department of Law Enforcement’s request, a
   30  covered entity must provide written documentation to the
   31  department demonstrating that it has paid the fees required
   32  under subparagraph 1.
   33         4.The failure of a covered entity to pay the fees required
   34  under subparagraph 1. is considered a violation of this section
   35  and subjects the covered entity to the penalties in subsection
   36  (11).
   37         Section 2. This act shall take effect on the same date that
   38  SB 640 or similar legislation takes effect, if such legislation
   39  is adopted in the same legislative session or an extension
   40  thereof and becomes a law.
