House Comm: RCS . 03/18/2025 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Appropriations Committee on Health and Human Services (Burton) recommended the following: 1 Senate Amendment 2 3 Delete lines 44 - 51 4 and insert: 5 patient’s nonopioid advance directive form who prescribes, 6 administers, or orders an opioid for the patient in a medical 7 emergency situation is not civilly or criminally liable for 8 failing to act in accordance with the directive unless the act 9 or omission was the result of a provider’s gross negligence or 10 willful misconduct. For purposes of this paragraph, the term 11 “medical emergency situation” includes an emergency medical 12 condition and emergency services and care, as those terms are 13 defined in s. 395.002.
