       The Committee on Fiscal Policy (Burton) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Before line 21
    4  insert:
    5         Section 1. Section 395.3042, Florida Statutes, is created
    6  to read:
    7         395.3042 Voluntary nonopioid patient form.—
    8         (1)As used in this section, the term “episode of care”
    9  includes all the services provided to a patient to clinically
   10  treat a condition, an illness, or a procedure.
   11         (2)The agency shall create and post on its website a
   12  voluntary nonopioid patient form that allows a person to
   13  indicate to a treating health care provider that the person
   14  should not be prescribed or administered an opioid drug during
   15  an episode of care. Each health care facility shall post the
   16  voluntary nonopioid patient form on the facility’s website or
   17  provide a link to the form on the agency’s website.
   18         (3)At the person’s request and before a specified episode
   19  of care, the form may be filed in the person’s medical record in
   20  a health care facility or a private office of a health care
   21  practitioner who is providing pretreatment or posttreatment
   22  care, or both, to the person for a specified episode of care
   23  related to the form. The form serves as a person’s directive
   24  related to treatment using opioid drugs during the episode of
   25  care at the facility or during the health care practitioner’s
   26  pretreatment or posttreatment care.
   27         (4)A person may revoke a voluntary nonopioid form for any
   28  reason and may do so by written or oral statement. The form
   29  expires upon the conclusion of the specified episode of care for
   30  which it was filed.

   33  And the title is amended as follows:
   34         Between lines 2 and 3
   35  insert:
   36         amending s. 395.3042, F.S.; defining the term “episode
   37         of care”; requiring the Agency for Health Care
   38         Administration to create and post on its website a
   39         voluntary nonopioid patient form; requiring each
   40         health care facility to post the form on its website
   41         or provide a link to the form on the agency’s website;
   42         providing for the filing of the form before a
   43         specified episode of care; providing for revocation
   44         and expiration of the form;
