    1                        A bill to be entitled                      
    2         An act relating to nonopioid advance directives;
    3         amending s. 395.3042, F.S.; defining the term “episode
    4         of care”; requiring the Agency for Health Care
    5         Administration to create and post on its website a
    6         voluntary nonopioid patient form; requiring each
    7         health care facility to post the form on its website
    8         or provide a link to the form on the agency’s website;
    9         providing for the filing of the form before a
   10         specified episode of care; providing for revocation
   11         and expiration of the form; providing an effective
   12         date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15  
   16         Section 1. Section 395.3042, Florida Statutes, is created
   17  to read:
   18         395.3042 Voluntary nonopioid patient form.—
   19         (1)As used in this section, the term “episode of care”
   20  includes all the services provided to a patient to clinically
   21  treat a condition, an illness, or a procedure.
   22         (2)The agency shall create and post on its website a
   23  voluntary nonopioid patient form that allows a person to
   24  indicate to a treating health care provider that the person
   25  should not be prescribed or administered an opioid drug during
   26  an episode of care. Each health care facility shall post the
   27  voluntary nonopioid patient form on the facility’s website or
   28  provide a link to the form on the agency’s website.
   29         (3)At the person’s request and before a specified episode
   30  of care, the form may be filed in the person’s medical record in
   31  a health care facility or a private office of a health care
   32  practitioner who is providing pretreatment or posttreatment
   33  care, or both, to the person for a specified episode of care
   34  related to the form. The form serves as a person’s directive
   35  related to treatment using opioid drugs during the episode of
   36  care at the facility or during the health care practitioner’s
   37  pretreatment or posttreatment care.
   38         (4)A person may revoke a voluntary nonopioid form for any
   39  reason and may do so by written or oral statement. The form
   40  expires upon the conclusion of the specified episode of care for
   41  which it was filed.
   42         Section 2. This act shall take effect July 1, 2025.
