Florida Senate - 2025 SB 722 By Senator Truenow 13-00923-25 2025722__ 1 A bill to be entitled 2 An act relating to location of equipment owned by 3 amusement business owners; defining the terms 4 “agricultural lands” and “amusement business owner”; 5 prohibiting counties and municipalities from enacting 6 certain policies, ordinances, regulations, or other 7 measures that require payment from an amusement 8 business owner for the placement, parking, or storage 9 of equipment for longer than a specified length of 10 time on certain lands classified as agricultural 11 lands; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. (1) For purposes of this section, the term: 16 (a) “Agricultural lands” means those parcels classified by 17 the property appraiser as agricultural lands under s. 193.461, 18 Florida Statutes. 19 (b) “Amusement business owner” means a provider of services 20 affiliated with a circus or carnival, such as rides, food, 21 beverages, and games, who travels around the United States on a 22 seasonal or temporary basis to provide such services to county 23 fairs, district fairs, state fairs, as those terms are defined 24 in s. 616.001, Florida Statutes, or who supports events 25 sponsored by not-for-profit organizations for fundraising. 26 (2) Notwithstanding any law to the contrary, a county or 27 municipality may not enact any policy, ordinance, regulation, or 28 other measure that addresses lands 5 acres or larger which are 29 classified as agricultural lands if such policy, ordinance, 30 regulation, or other measure requires a monetary exaction from 31 any amusement business owner whose equipment is placed, parked, 32 or stored on the agricultural land for 6 months or longer. This 33 prohibition applies only if the agricultural land is fully 34 fenced along the perimeter and if the equipment that is placed, 35 parked, or stored on the agricultural land is at least 100 feet 36 from the perimeter fencing. 37 Section 2. This act shall take effect July 1, 2025.
