    1                        A bill to be entitled                      
    2         An act relating to arrest warrants for state
    3         prisoners; creating s. 944.085, F.S.; authorizing a
    4         prisoner in a state prison who has an unserved warrant
    5         to file a notice of unserved warrant in the circuit
    6         court in which the warrant was issued; requiring the
    7         prisoner to serve the notice on the state attorney;
    8         requiring the circuit court to schedule the notice for
    9         a status hearing within a certain timeframe after
   10         receiving the notice; specifying procedures and
   11         requirements for the status hearing; requiring the
   12         court to send an order to the county sheriff;
   13         providing an effective date.

   15  Be It Enacted by the Legislature of the State of Florida:
   16  
   17         Section 1. Section 944.085, Florida Statutes, is created to
   18  read:
   19         944.085Unserved warrants of state prisoners.—
   20         (1)A prisoner in a state prison who has an unserved
   21  warrant for his or her arrest in this state may file a state
   22  prisoner’s notice of unserved warrant in the circuit court of
   23  the judicial circuit in which the unserved warrant was issued.
   24         (2)The prisoner must serve the notice upon the state
   25  attorney of the circuit. The circuit court shall schedule the
   26  notice for a status hearing within 90 days after receiving the
   27  notice. The prisoner may not be transported to the status
   28  hearing. At the status hearing, the state attorney shall inform
   29  the court as to whether there is an unserved warrant for the
   30  arrest of the prisoner.
   31         (3)If a warrant exists, the court must enter an order
   32  within 30 days after the status hearing for the transport of the
   33  prisoner to the county jail of the county that issued the
   34  warrant and the court shall send the order to the county sheriff
   35  for execution.
   36         Section 2. This act shall take effect July 1, 2025.
