       The Appropriations Committee on Transportation, Tourism, and
       Economic Development (Burgess) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Subsection (4) is added to section 373.423,
    6  Florida Statutes, to read:
    7         373.423 Inspection.—
    8         (4)(a) For purposes of this subsection:
    9         1. “MS4” means a municipal separate storm sewer as defined
   10  in 40 C.F.R. s. 122.26(b).
   11         2. “MS4 entity” means an MS4 permittee.
   12         (b) Each MS4 entity shall conduct annual operation and
   13  maintenance inspections of all permitted stormwater management
   14  systems owned or operated by the MS4 entity. As part of such
   15  inspections, the MS4 entity must identify any infrastructure
   16  within the MS4, or any component thereof, which:
   17         1. Has a significant vulnerability to obstruction,
   18  blockage, deterioration, failure, or other deficiencies; and
   19         2. Upon operational failure, would result in flooding and
   20  property damage.
   21         (c) The MS4 entity shall complete the stormwater facility
   22  inspection checklist developed by the department for each MS4
   23  inspected pursuant to this subsection. The completed checklist
   24  must be submitted to the department and the Division of
   25  Emergency Management by September 1, 2026, and by June 1 of each
   26  year thereafter. Each checklist must include any infrastructure
   27  within the MS4, or any component thereof identified pursuant to
   28  paragraph (b).
   29         Section 2. This act shall take effect July 1, 2025.

   35                        A bill to be entitled                      
   36         An act relating to stormwater management systems;
   37         amending s. 373.423, F.S.; defining the terms “MS4”
   38         and “MS4 entity”; requiring each MS4 entity to conduct
   39         annual operation and maintenance inspections of
   40         certain stormwater management systems; providing
   41         requirements for such inspections; requiring each MS4
   42         entity to complete a stormwater facility inspection
   43         checklist; requiring that such checklist be submitted
   44         to specified entities annually by a specified date;
   45         requiring that each checklist include certain
   46         information; providing an effective date.
