Florida Senate - 2025 CS for SB 810 By the Appropriations Committee on Transportation, Tourism, and Economic Development; and Senator Burgess 606-02760-25 2025810c1 1 A bill to be entitled 2 An act relating to stormwater management systems; 3 amending s. 373.423, F.S.; defining the terms “MS4” 4 and “MS4 entity”; requiring each MS4 entity to conduct 5 annual operation and maintenance inspections of 6 certain stormwater management systems; providing 7 requirements for such inspections; requiring each MS4 8 entity to complete a stormwater facility inspection 9 checklist; requiring that such checklist be submitted 10 to specified entities annually by a specified date; 11 requiring that each checklist include certain 12 information; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Subsection (4) is added to section 373.423, 17 Florida Statutes, to read: 18 373.423 Inspection.— 19 (4)(a) For purposes of this subsection: 20 1. “MS4” means a municipal separate storm sewer as defined 21 in 40 C.F.R. s. 122.26(b). 22 2. “MS4 entity” means an MS4 permittee. 23 (b) Each MS4 entity shall conduct annual operation and 24 maintenance inspections of all permitted stormwater management 25 systems owned or operated by the MS4 entity. As part of such 26 inspections, the MS4 entity must identify any infrastructure 27 within the MS4, or any component thereof, which: 28 1. Has a significant vulnerability to obstruction, 29 blockage, deterioration, failure, or other deficiencies; and 30 2. Upon operational failure, would result in flooding and 31 property damage. 32 (c) The MS4 entity shall complete the stormwater facility 33 inspection checklist developed by the department for each MS4 34 inspected pursuant to this subsection. The completed checklist 35 must be submitted to the department and the Division of 36 Emergency Management by September 1, 2026, and by June 1 of each 37 year thereafter. Each checklist must include any infrastructure 38 within the MS4, or any component thereof identified pursuant to 39 paragraph (b). 40 Section 2. This act shall take effect July 1, 2025.
