House Comm: RCS . 03/25/2025 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Environment and Natural Resources (Burgess) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 38 - 80 4 and insert: 5 378.213 Notice of former phosphate mine site.— 6 (1) A landowner may record a notice in the official records 7 of the county in which the land is located which identifies the 8 landowner’s property as a former phosphate mine. The recorded 9 notice must be in substantially the following form: 10 11 NOTICE 12 This property is a former phosphate mine as defined in 13 s. 378.213(2), Florida Statutes. 14 15 Such recording serves as notice that the land is a former 16 phosphate mine. 17 (2) As used in this section, the term “former phosphate 18 mine” means an area of land upon which phosphate mining has been 19 conducted and which may have been subject to a radiation survey 20 in accordance with s. 404.0561 and state reclamation 21 requirements of ss. 378.201-378.212, but does not include a 22 phosphogypsum stack as defined in s. 403.4154(1)(d). 23 Section 3. Section 404.0561, Florida Statutes, is created 24 to read: 25 404.0561 Survey of former phosphate mining lands.— 26 (1) Upon petition by a current landowner, the department 27 shall conduct a gamma radiation survey of a former phosphate 28 land parcel within 120 days after receipt of the petition to 29 determine the radioactivity levels. The survey must document 30 gamma radiation exposure measurements and the locations of the 31 measurements. Gamma radiation measurements must be taken at the 32 density of one per site or one per acre of land, whichever is 33 greater. 34 (2) The department shall provide a copy of the preliminary 35 survey results to the petitioner within 30 days after completion 36 of the survey. Within 60 days after receipt of the survey, the 37 petitioner may request an additional survey based upon any 38 reasonable belief that the survey was flawed or not 39 representative of conditions on the site. The department shall 40 conduct one additional survey within 90 days after receipt of 41 the petitioner’s request. The additional survey must meet the 42 requirements of this section and is deemed final within 90 days 43 after completion. 44 (3) A petitioner requesting a survey pursuant to this 45 section is responsible for the cost of the survey conducted by 46 the department. 47 48 ================= T I T L E A M E N D M E N T ================ 49 And the title is amended as follows: 50 Delete lines 5 - 13 51 and insert: 52 sites; creating s. 378.213, F.S.; authorizing 53 landowners to record certain notice of former 54 phosphate mines; specifying requirements for such 55 notice; defining the term “former phosphate mine”; 56 creating s. 404.0561, F.S.; requiring the Department 57 of Health to conduct surveys of former phosphate land 58 parcels upon petition; providing conditions and 59 requirements for such surveys; specifying that 60 petitioners bear the cost of surveys; creating s. 61 768.405,
