    1                        A bill to be entitled                      
    2         An act relating to county price controls for the
    3         removal and storage of electric vehicles; amending s.
    4         166.043, F.S.; requiring counties to establish
    5         specified rates for the removal and storage of
    6         electric vehicles from an accident scene; authorizing
    7         a wrecker operator to charge specified costs for the
    8         cleanup of an accident scene and removal of such
    9         vehicles; providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Paragraph (e) is added to subsection (1) of
   14  section 166.043, Florida Statutes, to read:
   15         166.043 Ordinances and rules imposing price controls.—
   16         (1)
   17         (e)1. Counties must establish maximum rates for the removal
   18  and storage of electric vehicles from an accident scene which
   19  may be up to 3 times the rates charged by a wrecker operator, as
   20  defined in s. 323.002(1), for the removal and storage of
   21  vehicles that run on gasoline or diesel fuels, in the event the
   22  electric vehicle owner or operator is incapacitated,
   23  unavailable, leaves the procurement of wrecker service to the
   24  law enforcement officer at the scene, or otherwise does not
   25  consent to the removal of the electric vehicle.
   26         2. A wrecker operator may charge for the fair and
   27  reasonable costs, plus 10 percent, for the cleanup of an
   28  accident scene and removal of an electric vehicle, including a
   29  fire or any accidental discharge of any hazardous materials or
   30  debris associated with the electric vehicle.
   31         Section 2. This act shall take effect July 1, 2025.
