House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Banking and Insurance (Calatayud) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Delete lines 24 - 59 4 and insert: 5 fertility preservation services when cancer treatments may 6 directly or indirectly cause iatrogenic infertility. 7 (b) Coverage of standard fertility preservation services 8 under this subsection includes the costs associated with 9 retrieving and preserving sperm and oocyte materials which are 10 consistent with nationally recognized clinical practice 11 guidelines and definitions. Coverage of retrieval and storage 12 expires after a period of 3 years from the date of the 13 procedures presenting a risk of iatrogenic infertility or when 14 the individual is no longer covered under the state group health 15 insurance plan, whichever occurs first. 16 (c) A state group health insurance plan may not require 17 preauthorization for coverage of standard fertility retrieval 18 and preservation services; however, a health benefit plan may 19 contain provisions for maximum benefits and may subject the 20 covered service to the same deductible, copayment, and 21 coinsurance. 22 (d) As used in this subsection, the term: 23 1. “Iatrogenic infertility” means an impairment of 24 fertility caused directly or indirectly by surgery, 25 chemotherapy, radiation, or other associated medically necessary 26 treatment with a potential side effect of impaired fertility as 27 established by the American Society for Reproductive Medicine. 28 2. “Nationally recognized clinical practice guidelines and 29 definitions” mean evidence-based clinical practice guidelines 30 developed by independent organizations or medical professional 31 societies using a transparent methodology and reporting 32 structure and with a conflict-of-interest policy, and 33 definitions used or established in said guidelines. Guidelines 34 developed by such organizations or societies must establish 35 standards of care informed by a systematic review of evidence 36 and an assessment of the benefits and costs of alternative care 37 options and include recommendations intended to optimize patient 38 care. 39 3. “Standard fertility retrieval and preservation services” 40 means oocyte and sperm retrieval and preservation procedures and 41 storage, including ovarian 42 43 ================= T I T L E A M E N D M E N T ================ 44 And the title is amended as follows: 45 Delete line 5 46 and insert: 47 of certain fertility retrieval and preservation 48 services for state
