Florida Senate - 2025 CS for SB 944 By the Committee on Banking and Insurance; and Senator Davis 597-02252-25 2025944c1 1 A bill to be entitled 2 An act relating to insurance overpayment claims 3 submitted to psychologists; amending ss. 627.6131 and 4 641.3155, F.S.; requiring that insurance overpayment 5 claims submitted to psychologists be submitted within 6 a specified timeframe; providing applicability; 7 providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsection (18) of section 627.6131, Florida 12 Statutes, is amended to read: 13 627.6131 Payment of claims.— 14 (18) Notwithstanding the 30-month period provided in 15 subsection (6), all claims for overpayment submitted to a 16 provider licensed under chapter 458, chapter 459, chapter 460, 17 chapter 461,orchapter 466, or chapter 490 must be submitted to 18 the provider within 12 months after the health insurer’s payment 19 of the claim. A claim for overpayment may not be permitted 20 beyond 12 months after the health insurer’s payment of a claim, 21 except that claims for overpayment may be sought beyond that 22 time from providers convicted of fraud pursuant to s. 817.234. 23 Section 2. Subsection (16) of section 641.3155, Florida 24 Statutes, is amended to read: 25 641.3155 Prompt payment of claims.— 26 (16) Notwithstanding the 30-month period provided in 27 subsection (5), all claims for overpayment submitted to a 28 provider licensed under chapter 458, chapter 459, chapter 460, 29 chapter 461,orchapter 466, or chapter 490 must be submitted to 30 the provider within 12 months after the health maintenance 31 organization’s payment of the claim. A claim for overpayment may 32 not be permitted beyond 12 months after the health maintenance 33 organization’s payment of a claim, except that claims for 34 overpayment may be sought beyond that time from providers 35 convicted of fraud pursuant to s. 817.234. 36 Section 3. The amendments made by this act to ss. 37 627.6131(18) and 641.3155(16), Florida Statutes, apply to claims 38 for services provided on or after January 1, 2026. 39 Section 4. This act shall take effect July 1, 2025.
