       The Committee on Environment and Natural Resources (Rodriguez)
       recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 28 - 52
    4  and insert:
    5         (13) PROHIBITION ON WASTE FACILITIES.—
    6         (a) Notwithstanding any law to the contrary, a state or
    7  local governmental entity may not approve any permit under
    8  chapter 373, chapter 376, chapter 377, chapter 379, chapter 380,
    9  or chapter 403 for the construction or operation of any of the
   10  following facilities that are proposed to be located within 1
   11  mile of the C-9 impoundment, authorized by the Water Resources
   12  Reform and Development Act of 2014, Pub. L. No. 113-121:
   13         1. A municipal solid waste-to-energy facility as defined in
   14  s. 377.814(2).
   15         2. A pyrolysis facility as defined in s. 403.703.
   16         3. To the extent that it includes incineration of any type,
   17  a solid waste disposal facility as defined in s. 403.703.
   18         (b) This subsection does not apply to a facility that was
   19  constructed and had an operating permit authorizing incineration
   20  before July 1, 2025.
