The Committee on Rules (Pizzo) recommended the following:

4 insert:
5 Section 9. Subsection (4) of section 551.114, Florida
6 Statutes, is amended to read:
7 551.114 Slot machine gaming areas.—
8 (4)(a) Designated slot machine gaming areas must be located
9 at the address specified in the licensed permitholder’s slot
10 machine license issued for fiscal year 2020-2021.
11 (b) Notwithstanding paragraph (a), a slot machine licensee
12 may apply to the commission to change the location of its
13 designated slot machine gaming area if all of the following
14 apply:
15 1. The location of the designated slot machine gaming area
16 is in the same county as the address specified in the licensed
17 permitholder’s slot machine license issued for fiscal year 2020
18 2021.
19 2. The location of the designated slot machine gaming area
20 is within 1,320 feet on a straight line of any outermost
21 boundary of the licensed permitholder’s designated slot machine
22 gaming area as of January 1, 2026.
23 3. The designated slot machine gaming area is at a location
24 where the licensed permitholder is authorized to conduct pari
25 mutuel wagering activities pursuant to the licensed
26 permitholder’s valid pari-mutuel permit.
27 4. The location is owned by the licensed pari-mutuel
28 permitholder.
29 5. The location is approved under the zoning regulations of
30 the county or municipality where the permitted slot machine
31 gaming area is to be located as a planned development use,
32 consistent with the comprehensive plan.
33 6. The location does not violate any of the provisions of
34 any tribal-state gaming compact with a federally recognized
35 Indian tribe located within this state pursuant to the Indian
36 Gaming Regulatory Act of 1988, 18 U.S.C. ss. 1166-1168, and 25
37 U.S.C. ss. 2701 et seq.
38 (c) Before submitting an application to the commission to
39 change the location of the designated slot machine gaming area,
40 the licensed pari-mutuel permitholder must submit a survey
41 indicating the existing location of the designated slot machine
42 gaming area and the proposed location of the new designated slot
43 machine gaming area.
44 (d) The commission is responsible for approving or denying
45 the application to change the location of the designated slot
46 machine gaming area. A slot machine licensee must apply to the
47 commission using forms adopted by the commission. The commission
48 shall examine the application and approve or deny the change of
49 location of the designated slot machine gaming area within the
50 timeframes required by s. 120.60. The commission may adopt rules
51 to implement this subsection.
