1 Senate Joint Resolution
2 A joint resolution proposing an amendment to Section 6
3 of Article IV and the creation of Section 14 in
4 Article IV of the State Constitution to require that
5 the Senate confirm appointments and removals made by
6 the Governor and to require that the Legislature
7 authorize an extension of a state of emergency
8 declared by the Governor.

10 Be It Resolved by the Legislature of the State of Florida:
11
12 That the following amendment to Section 6 of Article IV and
13 the creation of Section 14 of Article IV of the State
14 Constitution are agreed to and shall be submitted to the
15 electors of this state for approval or rejection at the next
16 general election or at an earlier special election specifically
17 authorized by law for that purpose:
18 ARTICLE IV
19 EXECUTIVE
20 SECTION 6. Executive departments.—All functions of the
21 executive branch of state government shall be allotted among not
22 more than twenty-five departments, exclusive of those
23 specifically provided for or authorized in this constitution.
24 The administration of each department, unless otherwise provided
25 in this constitution, shall be placed by law under the direct
26 supervision of the governor, the lieutenant governor, the
27 governor and cabinet, a cabinet member, or an officer or board
28 appointed by and serving at the pleasure of the governor,
29 except:
30 (a) When provided by law, Confirmation by the senate or the
31 approval of three members of the cabinet shall be required for
32 appointment to or removal from any designated statutory office.
33 (b) Boards authorized to grant and revoke licenses to
34 engage in regulated occupations shall be assigned to appropriate
35 departments and their members appointed for fixed terms, subject
36 to removal only for cause.
37 SECTION 14. Legislative ratification of a state of
38 emergency.—If the governor declares a state of emergency and
39 circumstances require that the state of emergency be extended
40 beyond 60 days, the governor may extend the state of emergency
41 beyond 60 days only if the legislature authorizes such
42 extension.
43 BE IT FURTHER RESOLVED that the following statement be
44 placed on the ballot:
45 CONSTITUTIONAL AMENDMENT
46 ARTICLE IV, SECTIONS 6 and 14
47 SENATE CONFIRMATION OF GUBERNATORIAL APPOINTMENTS;
48 LEGISLATIVE APPROVAL OF EXTENDED STATES OF EMERGENCY.—Proposing
49 an amendment to the State Constitution to require that
50 appointments to and removals from designated statutory offices
51 made by the Governor be confirmed by the Senate and to remove
52 the present authority of three members of the Cabinet approving
53 such appointments and removals. The amendment also requires that
54 the Legislature authorize any extension of a declared state of
55 emergency by the Governor which exceeds 60 days.
