       Senator Yarborough moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 33 - 50
    4  and insert:
    5         569.216 Prohibition on possessing, selling, delivering, or
    6  giving nitrous oxide; penalties; exceptions.—
    7         (1) It is unlawful for any dealer who is licensed or
    8  permitted under this chapter, or a dealer’s agent or employee,
    9  to possess, sell, possess with intent to sell, deliver, or give,
   10  directly or indirectly, nitrous oxide on or from the dealer’s
   11  licensed premises. A dealer or a dealer’s agent or employee who
   12  violates this subsection commits a felony of the third degree,
   13  punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
   14         (2) This section does not apply to a grocery store or
   15  supermarket, as licensed or permitted by the Department of
   16  Agriculture and Consumer Services, but does apply to a
   17  convenience business, as defined by s. 812.171.
   18         (3) This section does not prohibit the possession, sale,
   19  delivery, or giving of a finished food product in which nitrous
   20  oxide is used solely as a propellant.
   21         (4) The Department of Business and Professional Regulation
   22  shall adopt rules regarding the possession, sale, delivery, or
   23  giving of nitrous
