The Committee on Judiciary (Simon) recommended the following:
1 Senate Amendment (with title amendment)

3 Delete lines 597 - 611
4 and insert:
5 (k) Athletic coach and activity sponsor of extracurricular
6 activities compensation.—The district school board may, at its
7 sole discretion, determine and approve the compensation of any
8 person employed as an athletic coach, assistant coach, athletic
9 program supervisor, or activity sponsor of an extracurricular
10 activity, regardless of whether such individual is classified as
11 instructional personnel. Compensation may exceed any salary
12 schedule, supplement, or stipend otherwise prescribed and may be
13 paid in any form or amount deemed appropriate by the district
14 school board, including, but not limited to, salaries, stipends,
15 bonuses, performance-based incentives, and hourly or per
16 assignment pay. School districts may adopt a policy that
17 authorizes payments by booster clubs or associations to be
18 included in the compensation for an athletic coach and activity
19 sponsor of extracurricular activities. Such compensation is
20 considered part of the individual’s total compensation. The
21 limitations on supplemental pay applicable to instructional
22 personnel under this section or any other law do not apply to
23 compensation provided under this paragraph.

26 And the title is amended as follows:
27 Delete lines 50 - 57
28 and insert:
29 compensation of an athletic coach or sponsor of an
30 extracurricular activity; providing that the
31 compensation may exceed any prescribed salary
32 schedule, supplement, or stipend and be paid in any
33 form or amount deemed appropriate by the school board;
34 providing that such compensation is considered part of
35 the athletic coach’s or sponsor’s total compensation;
36 authorizing district school board policy to include
37 payments by certain entities to be included in
38 compensation; providing that limitations on
39 supplemental pay are not applicable to the
40 compensation of an athletic coach or activity sponsor;
