The Committee on Fiscal Policy (Arrington) recommended the
following:

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. Present subsections (4) through (7) of section
6 828.12, Florida Statutes, are redesignated as subsections (6)
7 through (9), respectively, new subsections (4) and (5) are added
8 to that section, present subsection (7) of that section is
9 amended, and subsections (1) and (2) of that section are
10 republished, to read:
11 828.12 Cruelty to animals.—
12 (1) A person who unnecessarily overloads, overdrives,
13 torments, deprives of necessary sustenance or shelter, or
14 unnecessarily mutilates, or kills any animal, or causes the same
15 to be done, or carries in or upon any vehicle, or otherwise, any
16 animal in a cruel or inhumane manner, commits animal cruelty, a
17 misdemeanor of the first degree, punishable as provided in s.
18 775.082 or by a fine of not more than $5,000, or both.
19 (2) A person who intentionally commits an act to any
20 animal, or a person who owns or has the custody or control of
21 any animal and fails to act, which results in the cruel death,
22 or excessive or repeated infliction of unnecessary pain or
23 suffering, or causes the same to be done, commits aggravated
24 animal cruelty, a felony of the third degree, punishable as
25 provided in s. 775.082 or by a fine of not more than $10,000, or
26 both.
27 (a) A person convicted of a violation of this subsection,
28 where the finder of fact determines that the violation includes
29 the knowing and intentional torture or torment of an animal that
30 injures, mutilates, or kills the animal, shall be ordered to pay
31 a minimum mandatory fine of $2,500 and undergo psychological
32 counseling or complete an anger management treatment program.
33 (b) A person convicted of a second or subsequent violation
34 of this subsection shall be required to pay a minimum mandatory
35 fine of $5,000 and serve a minimum mandatory period of
36 incarceration of 6 months. In addition, the person shall be
37 released only upon expiration of sentence, is not eligible for
38 parole, control release, or any form of early release, and must
39 serve 100 percent of the court-imposed sentence. Any plea of
40 nolo contendere shall be considered a conviction for purposes of
41 this subsection.
42 (4) A person 18 years of age or older commits a felony of
43 the third degree, punishable as provided in s. 775.082, s.
44 775.083, or s. 775.084, if he or she causes or entices a minor
45 to commit, or in the presence of a minor commits, a violation of
46 subsection (2).
47 (5)(a) If a minor commits an act of animal cruelty as
48 described in subsection (1) or subsection (2), the juvenile
49 court must order the minor to undergo a psychological evaluation
50 and, if recommended, receive counseling or treatment for a
51 length of time as prescribed by the juvenile court.
52 (b) The minor’s parent or guardian, or the state if the
53 minor is a ward of the state, shall pay the cost of the
54 psychological evaluation, counseling, or treatment as ordered by
55 the juvenile court in paragraph (a). If the juvenile court makes
56 a finding of indigency and significant financial hardship, the
57 court shall waive the fee or reduce it to an amount deemed
58 appropriate. If the minor’s parent or guardian willfully refuses
59 to follow the recommended treatment for the minor, the juvenile
60 court may hold the parent or guardian in contempt.
61 (9)(a)(7) Before Beginning January 1, 2027 2026, the
62 Department of Law Enforcement shall post on its website, in a
63 searchable format prescribed by the department, the name and all
64 aliases, date of birth, race, county of conviction, charge or
65 charges, case number, disposition, and description of any
66 identifying marks and tattoos and a photograph taken at the time
67 of booking related to the animal cruelty offense of each
68 individual names of those individuals who has have been
69 convicted of, or who has have entered a plea of guilty or nolo
70 contendere to, regardless of adjudication, a violation of this
71 section.
72 (b) The department shall post the information about each
73 individual as required in paragraph (a) for the following
74 periods:
75 1. Three years from the date of conviction, for a first
76 conviction of a misdemeanor offense.
77 2. Five years from the date of conviction, for a first
78 conviction of a felony offense.
79 3. Ten years from the date of conviction, for a subsequent
80 conviction of either a misdemeanor or felony offense.
81 (c) The department shall develop a procedure to allow a
82 person whose conviction has been overturned or who has received
83 a sealing of the criminal history record for which his or her
84 information was publicly posted as required in paragraph (a) to
85 petition for the removal of his or her information. The
86 department, after receiving a petition with adequate
87 documentation, must remove such information from the website
88 within 30 days. The department may adopt rules to implement this
89 paragraph.
90 (d) Each clerk of court and county detention facility must
91 provide the Department of Law Enforcement with the information,
92 data, and images required in paragraph (a).
93 Section 2. Present subsections (4) through (10) of section
94 828.122, Florida Statutes, are redesignated as subsections (5)
95 through (11), respectively, a new subsection (4) is added to
96 that section, and subsection (3) of that section is amended, to
97 read:
98 828.122 Fighting or baiting animals; offenses; penalties.—
99 (3) Any person who knowingly commits any of the following
100 acts commits a felony of the third degree, punishable as
101 provided in s. 775.082, s. 775.083, or s. 775.084:
102 (a) Baiting, breeding, training, transporting, selling,
103 owning, possessing, or using any wild or domestic animal for the
104 purpose of animal fighting or baiting;
105 (b) Owning, possessing, or selling equipment for use in any
106 activity described in paragraph (a);
107 (c) Owning, leasing, managing, operating, or having control
108 of any property kept or used for any activity described in
109 paragraph (a) or paragraph (b);
110 (d) Promoting, staging, advertising, or charging any
111 admission fee to a fight or baiting between two or more animals;
112 (e) Performing any service or act to facilitate animal
113 fighting or baiting, including, but not limited to, providing
114 security, refereeing, or handling or transporting animals or
115 being a stakeholder of any money wagered on animal fighting or
116 baiting;
117 (f) Removing or facilitating the removal of any animal
118 impounded under this section from an agency where the animal is
119 impounded or from a location designated by the court under
120 subsection (5) (4), subsection (6) (5), or subsection (8) (7),
121 without the prior authorization of the court;
122 (g) Betting or wagering any money or other valuable
123 consideration on the fighting or baiting of animals; or
124 (h) Attending the fighting or baiting of animals.

126 Notwithstanding any provision of this subsection to the
127 contrary, possession of the animal alone does not constitute a
128 violation of this section.
129 (4) A person 18 years of age or older commits a felony of
130 the third degree, punishable as provided in s. 775.082, s.
131 775.083, or s. 775.084, if he or she causes or entices a minor
132 to commit, or in the presence of a minor commits, a violation of
133 subsection (3).
134 Section 3. Present subsections (4) and (5) of section
135 828.126, Florida Statutes, are redesignated as subsections (5)
136 and (6), respectively, a new subsection (4) is added to that
137 section, and subsection (2) of that section is republished, to
138 read:
139 828.126 Sexual activities involving animals.—
140 (2) A person may not:
141 (a) Knowingly engage in any sexual contact with an animal;
142 (b) Knowingly cause, aid, or abet another person to engage
143 in any sexual contact with an animal;
144 (c) Knowingly permit any sexual contact with an animal to
145 be conducted on any premises under his or her charge or control;
146 (d) Knowingly organize, promote, conduct, aid, abet,
147 participate in as an observer, or advertise, offer, solicit, or
148 accept an offer of an animal for the purpose of sexual contact
149 with such animal, or perform any service in the furtherance of
150 an act involving any sexual contact with an animal; or
151 (e) Knowingly film, distribute, or possess any pornographic
152 image or video of a person and an animal engaged in any of the
153 activities prohibited by this section.
154 (4) A person 18 years of age or older commits a felony of
155 the third degree, punishable as provided in s. 775.082, s.
156 775.083, or s. 775.084, if he or she causes or entices a minor
157 to commit, or in the presence of a minor commits, a violation of
158 subsection (2).
159 Section 4. Subsection (2) of section 828.27, Florida
160 Statutes, is amended to read:
161 828.27 Local animal control or cruelty ordinances;
162 penalty.—
163 (2) The governing body of a county or municipality is
164 authorized to enact ordinances relating to animal control or
165 cruelty, which ordinances must provide:
166 (a) That a violation of such an ordinance is a civil
167 infraction.
168 (b) A maximum civil penalty not to exceed:
169 1. Two thousand five hundred dollars for a first violation.
170 2. Five thousand dollars for a second violation.
171 3. Seven thousand five hundred dollars for a third or
172 subsequent violation $500.
173 (c) A civil penalty of less than the maximum civil penalty
174 if the person who has committed the civil infraction does not
175 contest the citation.
176 (d) For the issuance of a citation by an officer who has
177 probable cause to believe that a person has committed an act in
178 violation of an ordinance.
179 (e) For the contesting of a citation in the county court.
180 (f) That, if a person fails to pay the civil penalty, fails
181 to appear in court to contest the citation, or fails to appear
182 in court as required by subsection (6), the court may issue an
183 order to show cause upon the request of the governing body of
184 the county or municipality. This order shall require such
185 persons to appear before the court to explain why action on the
186 citation has not been taken. If any person who is issued such
187 order fails to appear in response to the court’s directive, that
188 person may be held in contempt of court.
189 (g) Such procedures and provisions as are necessary to
190 implement any ordinances enacted under the authority of this
191 section.
