    1                        A bill to be entitled                      
    2         An act relating to animal welfare; amending s. 828.12,
    3         F.S.; creating the offense of causing or enticing a
    4         minor to commit, or in the presence of a minor
    5         committing, animal cruelty; requiring a court to order
    6         a minor who commits specified acts of animal cruelty
    7         to undergo a psychological evaluation and, if
    8         recommended, receive counseling or treatment for a
    9         specified time period; requiring the minor’s parent or
   10         guardian or the state to pay the cost of such
   11         evaluation, counseling, and treatment; providing an
   12         exception; authorizing the court to hold the parent or
   13         guardian in contempt under certain circumstances;
   14         requiring the Department of Law Enforcement to post on
   15         its website specified information relating to each
   16         individual convicted of specified animal cruelty
   17         offenses; specifying time periods for which the
   18         information shall be posted; requiring the department
   19         to develop a procedure to allow a person to petition
   20         for the removal of his or her information under
   21         specified circumstances; requiring the department to
   22         remove specified information under specified
   23         circumstances; specifying the time period within which
   24         such information must be removed; authorizing the
   25         department to adopt rules; requiring clerks of court
   26         and county detention facilities to provide the
   27         Department of Law Enforcement with specified
   28         information, data, and images; amending s. 828.122,
   29         F.S.; creating the offense of causing or enticing a
   30         minor to commit, or in the presence of a minor
   31         committing, fighting or baiting animals; amending s.
   32         828.126, F.S.; creating the offense of causing or
   33         enticing a minor to commit, or in the presence of a
   34         minor committing, sexual activities involving animals;
   35         amending s. 828.27, F.S.; increasing the maximum civil
   36         penalty for specified violations of ordinances
   37         relating to animal control or cruelty; amending s.
   38         921.0022, F.S.; increasing the level on the offense
   39         severity ranking chart for fighting or baiting
   40         animals; ranking offenses created by the act on the
   41         offense severity ranking chart; providing an effective
   42         date.
   43          
   44  Be It Enacted by the Legislature of the State of Florida:
   45  
   46         Section 1. Present subsections (4) through (7) of section
   47  828.12, Florida Statutes, are redesignated as subsections (6)
   48  through (9), respectively, new subsections (4) and (5) are added
   49  to that section, present subsection (7) of that section is
   50  amended, and subsections (1) and (2) of that section are
   51  republished, to read:
   52         828.12 Cruelty to animals.—
   53         (1) A person who unnecessarily overloads, overdrives,
   54  torments, deprives of necessary sustenance or shelter, or
   55  unnecessarily mutilates, or kills any animal, or causes the same
   56  to be done, or carries in or upon any vehicle, or otherwise, any
   57  animal in a cruel or inhumane manner, commits animal cruelty, a
   58  misdemeanor of the first degree, punishable as provided in s.
   59  775.082 or by a fine of not more than $5,000, or both.
   60         (2) A person who intentionally commits an act to any
   61  animal, or a person who owns or has the custody or control of
   62  any animal and fails to act, which results in the cruel death,
   63  or excessive or repeated infliction of unnecessary pain or
   64  suffering, or causes the same to be done, commits aggravated
   65  animal cruelty, a felony of the third degree, punishable as
   66  provided in s. 775.082 or by a fine of not more than $10,000, or
   67  both.
   68         (a) A person convicted of a violation of this subsection,
   69  where the finder of fact determines that the violation includes
   70  the knowing and intentional torture or torment of an animal that
   71  injures, mutilates, or kills the animal, shall be ordered to pay
   72  a minimum mandatory fine of $2,500 and undergo psychological
   73  counseling or complete an anger management treatment program.
   74         (b) A person convicted of a second or subsequent violation
   75  of this subsection shall be required to pay a minimum mandatory
   76  fine of $5,000 and serve a minimum mandatory period of
   77  incarceration of 6 months. In addition, the person shall be
   78  released only upon expiration of sentence, is not eligible for
   79  parole, control release, or any form of early release, and must
   80  serve 100 percent of the court-imposed sentence. Any plea of
   81  nolo contendere shall be considered a conviction for purposes of
   82  this subsection.
   83         (4)A person 18 years of age or older commits a felony of
   84  the third degree, punishable as provided in s. 775.082, s.
   85  775.083, or s. 775.084, if he or she causes or entices a minor
   86  to commit, or in the presence of a minor commits, a violation of
   87  subsection (2).
   88         (5)(a)If a minor commits an act of animal cruelty as
   89  described in subsection (1) or subsection (2), the juvenile
   90  court must order the minor to undergo a psychological evaluation
   91  and, if recommended, receive counseling or treatment for a
   92  length of time as prescribed by the juvenile court.
   93         (b)The minor’s parent or guardian, or the state if the
   94  minor is a ward of the state, shall pay the cost of the
   95  psychological evaluation, counseling, or treatment as ordered by
   96  the juvenile court in paragraph (a). If the juvenile court makes
   97  a finding of indigency and significant financial hardship, the
   98  court shall waive the fee or reduce it to an amount deemed
   99  appropriate. If the minor’s parent or guardian willfully refuses
  100  to follow the recommended treatment for the minor, the juvenile
  101  court may hold the parent or guardian in contempt.
  102         (9)(a)(7)Before Beginning January 1, 2027 2026, the
  103  Department of Law Enforcement shall post on its website, in a
  104  searchable format prescribed by the department, the name and all
  105  aliases, date of birth, race, county of conviction, charge or
  106  charges, case number, disposition, and description of any
  107  identifying marks and tattoos and a photograph taken at the time
  108  of booking related to the animal cruelty offense of each
  109  individual names of those individuals who has have been
  110  convicted of, or who has have entered a plea of guilty or nolo
  111  contendere to, regardless of adjudication, a violation of this
  112  section.
  113         (b)The department shall post the information about each
  114  individual as required in paragraph (a) for the following
  115  periods:
  116         1.Three years from the date of conviction, for a first
  117  conviction of a misdemeanor offense.
  118         2.Five years from the date of conviction, for a first
  119  conviction of a felony offense.
  120         3.Ten years from the date of conviction, for a subsequent
  121  conviction of either a misdemeanor or felony offense.
  122         (c)The department shall develop a procedure to allow a
  123  person whose conviction has been overturned or who has received
  124  a sealing of the criminal history record for which his or her
  125  information was publicly posted as required in paragraph (a) to
  126  petition for the removal of his or her information. The
  127  department, after receiving a petition with adequate
  128  documentation, must remove such information from the website
  129  within 30 days. The department may adopt rules to implement this
  130  paragraph.
  131         (d)Each clerk of court and county detention facility must
  132  provide the Department of Law Enforcement with the information,
  133  data, and images required in paragraph (a).
  134         Section 2. Present subsections (4) through (10) of section
  135  828.122, Florida Statutes, are redesignated as subsections (5)
  136  through (11), respectively, a new subsection (4) is added to
  137  that section, and subsection (3) of that section is amended, to
  138  read:
  139         828.122 Fighting or baiting animals; offenses; penalties.—
  140         (3) Any person who knowingly commits any of the following
  141  acts commits a felony of the third degree, punishable as
  142  provided in s. 775.082, s. 775.083, or s. 775.084:
  143         (a) Baiting, breeding, training, transporting, selling,
  144  owning, possessing, or using any wild or domestic animal for the
  145  purpose of animal fighting or baiting;
  146         (b) Owning, possessing, or selling equipment for use in any
  147  activity described in paragraph (a);
  148         (c) Owning, leasing, managing, operating, or having control
  149  of any property kept or used for any activity described in
  150  paragraph (a) or paragraph (b);
  151         (d) Promoting, staging, advertising, or charging any
  152  admission fee to a fight or baiting between two or more animals;
  153         (e) Performing any service or act to facilitate animal
  154  fighting or baiting, including, but not limited to, providing
  155  security, refereeing, or handling or transporting animals or
  156  being a stakeholder of any money wagered on animal fighting or
  157  baiting;
  158         (f) Removing or facilitating the removal of any animal
  159  impounded under this section from an agency where the animal is
  160  impounded or from a location designated by the court under
  161  subsection (5) (4), subsection (6) (5), or subsection (8) (7),
  162  without the prior authorization of the court;
  163         (g) Betting or wagering any money or other valuable
  164  consideration on the fighting or baiting of animals; or
  165         (h) Attending the fighting or baiting of animals.
  166  
  167  Notwithstanding any provision of this subsection to the
  168  contrary, possession of the animal alone does not constitute a
  169  violation of this section.
  170         (4)A person 18 years of age or older commits a felony of
  171  the third degree, punishable as provided in s. 775.082, s.
  172  775.083, or s. 775.084, if he or she causes or entices a minor
  173  to commit, or in the presence of a minor commits, a violation of
  174  subsection (3).
  175         Section 3. Present subsections (4) and (5) of section
  176  828.126, Florida Statutes, are redesignated as subsections (5)
  177  and (6), respectively, a new subsection (4) is added to that
  178  section, and subsection (2) of that section is republished, to
  179  read:
  180         828.126 Sexual activities involving animals.—
  181         (2) A person may not:
  182         (a) Knowingly engage in any sexual contact with an animal;
  183         (b) Knowingly cause, aid, or abet another person to engage
  184  in any sexual contact with an animal;
  185         (c) Knowingly permit any sexual contact with an animal to
  186  be conducted on any premises under his or her charge or control;
  187         (d) Knowingly organize, promote, conduct, aid, abet,
  188  participate in as an observer, or advertise, offer, solicit, or
  189  accept an offer of an animal for the purpose of sexual contact
  190  with such animal, or perform any service in the furtherance of
  191  an act involving any sexual contact with an animal; or
  192         (e) Knowingly film, distribute, or possess any pornographic
  193  image or video of a person and an animal engaged in any of the
  194  activities prohibited by this section.
  195         (4)A person 18 years of age or older commits a felony of
  196  the third degree, punishable as provided in s. 775.082, s.
  197  775.083, or s. 775.084, if he or she causes or entices a minor
  198  to commit, or in the presence of a minor commits, a violation of
  199  subsection (2).
  200         Section 4. Subsection (2) of section 828.27, Florida
  201  Statutes, is amended to read:
  202         828.27 Local animal control or cruelty ordinances;
  203  penalty.—
  204         (2) The governing body of a county or municipality is
  205  authorized to enact ordinances relating to animal control or
  206  cruelty, which ordinances must provide:
  207         (a) That a violation of such an ordinance is a civil
  208  infraction.
  209         (b) A maximum civil penalty not to exceed:
  210         1.Two thousand five hundred dollars for a first violation.
  211         2.Five thousand dollars for a second violation.
  212         3.Seven thousand five hundred dollars for a third or
  213  subsequent violation $500.
  214         (c) A civil penalty of less than the maximum civil penalty
  215  if the person who has committed the civil infraction does not
  216  contest the citation.
  217         (d) For the issuance of a citation by an officer who has
  218  probable cause to believe that a person has committed an act in
  219  violation of an ordinance.
  220         (e) For the contesting of a citation in the county court.
  221         (f) That, if a person fails to pay the civil penalty, fails
  222  to appear in court to contest the citation, or fails to appear
  223  in court as required by subsection (6), the court may issue an
  224  order to show cause upon the request of the governing body of
  225  the county or municipality. This order shall require such
  226  persons to appear before the court to explain why action on the
  227  citation has not been taken. If any person who is issued such
  228  order fails to appear in response to the court’s directive, that
  229  person may be held in contempt of court.
  230         (g) Such procedures and provisions as are necessary to
  231  implement any ordinances enacted under the authority of this
  232  section.
  233         Section 5. Paragraphs (a), (e), (f), and (g) of subsection
  234  (3) of section 921.0022, Florida Statutes, are amended to read:
