       Senator Berman moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 15 - 17
    4  and insert:
    5         Section 2. Subsections (2) and (3) of section 252.3711,
    6  Florida Statutes, are amended to read:
    7         252.3711 Emergency Preparedness and Response Fund.—
    8         (2)(a) The fund is established for use as a depository for
    9  moneys specifically transferred or appropriated to the fund. The
   10  moneys deposited in the fund are available as a primary funding
   11  source for the Governor for purposes of:
   12         1. Preparing or responding to a natural emergency that has
   13  been disaster declared or renewed by the Governor as a state of
   14  emergency that exceeds regularly appropriated funding sources;
   15  or
   16         2. Preparing or responding to any other disaster that has
   17  been declared or renewed by the Governor as a state of emergency
   18  that exceeds regularly appropriated funding sources.
   19         (b) If the Governor renews a declared state of emergency
   20  for a disaster described in subparagraph (a)2., the Legislative
   21  Budget Commission must approve the continued use of the fund to
   22  respond to such disaster.
