       Senator Mayfield moved the following:
       
    1         Senate Amendment (with title amendment)

    4  insert:
    5         Section 13. Subsection (8) of section 514.0115, Florida
    6  Statutes, is amended to read:
    7         514.0115 Exemptions from supervision or regulation;
    8  variances.—
    9         (8) Until such time as the department adopts rules for the
   10  supervision and regulation of surf pools, a surf pool that is
   11  larger than one-quarter acre 4 acres is exempt from supervision
   12  under this chapter if the surf pool is permitted by a local
   13  government pursuant to a special use permit process in which the
   14  local government asserts regulatory authority over the
   15  construction of the surf pool and, in consultation with the
   16  department, establishes through the local government’s special
   17  use permitting process the conditions for the surf pool’s
   18  operation, water quality, and necessary lifesaving equipment.
   19  This subsection does not affect the department’s or a county
   20  health department’s right of entry pursuant to s. 514.04 or its
   21  authority to seek an injunction pursuant to s. 514.06 to
   22  restrain the operation of a surf pool permitted and operated
   23  under this subsection if the surf pool presents significant
   24  risks to public health. For the purposes of this subsection, the
   25  term “surf pool” means a pool that is designed to generate waves
   26  dedicated to the activity of surfing on a surfboard or an
   27  analogous surfing device commonly used in the ocean and intended
   28  for sport, as opposed to the general play intent of wave pools,
   29  other large-scale public swimming pools, or other public bathing
   30  places.

   36         514.0115, F.S.; revising the criteria for surf pools
   37         that are exempt from supervision of the department;
   38         amending s.
