The Committee on Rules (Martin) recommended the following:
1 Senate Amendment (with title amendment)

3 Delete everything after the enacting clause
4 and insert:
5 Section 1. This act may be cited as “Missy’s Law.”
6 Section 2. Section 903.0472, Florida Statutes, is created
7 to read:
8 903.0472 Mandatory remand to custody upon conviction of
9 dangerous crimes.—
10 (1) Notwithstanding any provision in this chapter or
11 chapter 924 to the contrary, the court shall remand a person to
12 custody immediately, and the person shall remain in custody
13 pending sentencing without the possibility of release on bond,
14 if the person pleads guilty or nolo contendere to, or is found
15 guilty of, regardless of adjudication, a dangerous crime as
16 defined in s. 907.041(5)(a).
17 (2) This section applies regardless of whether the person
18 intends to appeal or has filed a notice of appeal.
19 (3) This section does not apply if the plea or finding of
20 guilt that required the person to be remanded to custody under
21 subsection (1) has been:
22 (a) Vacated;
23 (b) Reversed on appeal;
24 (c) Set aside by judgment of acquittal; or
25 (d) Otherwise nullified.
26 (4) This section may not be construed to allow the remand
27 of a person to custody if such person has served the maximum
28 statutory sentence for the offense.
29 Section 3. Paragraph (a) of subsection (5) of section
30 907.041, Florida Statutes, is amended to read:
31 907.041 Pretrial detention and release.—
32 (5) PRETRIAL DETENTION.—
33 (a) As used in this subsection, “dangerous crime” means any
34 of the following:
35 1. Arson;
36 2. Aggravated assault;
37 3. Aggravated battery;
38 4. Illegal use of explosives;
39 5. Child abuse or aggravated child abuse;
40 6. Abuse of an elderly person or disabled adult, or
41 aggravated abuse of an elderly person or disabled adult;
42 7. Aircraft piracy;
43 8. Kidnapping;
44 9. Homicide;
45 10. Manslaughter, including DUI manslaughter and BUI
46 manslaughter;
47 11. Sexual battery;
48 12. Robbery;
49 13. Carjacking;
50 14. Lewd, lascivious, or indecent assault or act upon or in
51 presence of a child under the age of 16 years;
52 15. Sexual activity with a child, who is 12 years of age or
53 older but less than 18 years of age, by or at solicitation of
54 person in familial or custodial authority;
55 16. Burglary of a dwelling;
56 17. Stalking and aggravated stalking;
57 18. Act of domestic violence as defined in s. 741.28;
58 19. Home invasion robbery;
59 20. Act of terrorism as defined in s. 775.30;
60 21. Manufacturing any substances in violation of chapter
61 893;
62 22. Attempting or conspiring to commit any such crime;
63 22.23. Human trafficking;
64 23.24. Trafficking in any controlled substance described in
65 s. 893.135(1)(c)4.;
66 24.25. Extortion in violation of s. 836.05; and
67 25.26. Written threats to kill in violation of s. 836.10;
68 26. Any violation related to computer pornography or child
69 exploitation as described in s. 847.0135; and
70 27. Attempting or conspiring to commit any such crime.
71 Section 4. This act shall take effect July 1, 2026.

78 An act relating to dangerous crimes; providing a short
79 title; creating s. 903.0472, F.S.; requiring a court
80 to remand to custody immediately a person who pleads
81 guilty or nolo contendere to, or is found guilty of, a
82 dangerous crime; requiring such person to remain in
83 custody pending sentencing without the possibility of
84 release on bond; providing applicability; providing
85 construction; amending s. 907.041, F.S.; revising the
86 definition of the term “dangerous crime”; providing an
87 effective date.
