Florida Senate - 2023 SB 1248 By Senator Ingoglia 11-00620A-23 20231248__ 1 A bill to be entitled 2 An act relating to political parties; providing a 3 short title; amending s. 103.091, F.S.; requiring the 4 Division of Elections to immediately cancel the 5 filings of a political party if certain conditions 6 exist; requiring the division to follow a certain 7 procedure; requiring the division to provide a 8 specified notice to certain voters; authorizing a 9 canceled political party to reregister with the 10 Department of State; providing procedures for an 11 organization to reregister as a political party; 12 providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. This act may be cited as “The Ultimate Cancel 17 Act.” 18 Section 2. Subsection (9) is added to section 103.091, 19 Florida Statutes, to read: 20 103.091 Political parties.— 21 (9) The division shall immediately cancel the filings of a 22 political party, to include its registration and approved status 23 as a political party, if the party’s platform has previously 24 advocated for, or been in support of, slavery or involuntary 25 servitude. In addition to applicable procedures provided for in 26 s. 103.095(5), the following procedures must also be followed: 27 (a) If the division cancels the filings of a political 28 party, the division must provide notice to each voter registered 29 with the canceled political party that the political party has 30 been canceled and his or her voter registration information will 31 now reflect “No Party Affiliation,” and provide procedures for 32 the voter to update his or her party affiliation to an active 33 political party. 34 (b) Any political party canceled pursuant to this 35 subsection may reregister with the department by filing a 36 certificate showing the name of the organization and the names 37 and addresses of its current officers, including the members of 38 its executive committee, accompanied by a completed uniform 39 statewide voter registration application as specified in s. 40 97.052 for each of its current officers and members of its 41 executive committee which reflects their affiliation with the 42 proposed political party, and a copy of its constitution, 43 bylaws, and rules and regulations. 44 1. The name of the organization must be substantially 45 different from the name of any other party previously registered 46 with the department. 47 2. The filing may not be submitted later than 6 months 48 before any election in which the political party seeking to 49 register wishes to nominate candidates for public office. 50 Section 3. This act shall take effect July 1, 2023.
