Section 456.60, Florida Statutes, is created to 7 read: 8 456.60 Standards for telemedicine; rulemaking authority; 9 requirements.—On or before March 31, 2014, the Board of Medicine 10 shall adopt rules for physicians licensed under chapter 458 11 which allows the provision of health care services to patients 12 via telemedicine by Florida-licensed health care practitioners. 13 (1) The rules for telemedicine services must include, but 14 need not be limited to, the use of interactive audio, video, 15 secure chat, secure email, electronic media, or telephone for 16 the practice of health care delivery, diagnosis, consultation, 17 treatment, transfer of medical data, or exchange of medical 18 education information by a health care provider to deliver 19 health care services at a site other than the site of the 20 patient’s location. 21 (2) The rules for telemedicine services must provide 22 requirements for the following: 23 (a) Licensure for the provision of telemedicine services; 24 (b) Standard of care requirements for health care 25 practitioners practicing telemedicine which are the same 26 standard of care requirements applicable to practitioners 27 practicing in other care settings; and 28 (c) Conducting patient evaluations and prescribing legend 29 drugs, other than controlled substances, via telemedicine. 30 31 ================= T I T L E A M E N D M E N T ================ 32 And the title is amended as follows: 33 Between lines 328 and 329 34 insert: 35 creating s. 456.60, F.S.; requiring the Board of 36 Medicine to adopt rules for physicians which allow for 37 the provision of health care services by telemedicine; 38 providing criteria and requirements;
