HB 1017: Mental Health and Substance Abuse

GENERAL BILL by Latvala

Mental Health and Substance Abuse; Authorizes family member of patient or an interested party to petition court for appointment of guardian advocate; establishes Substance Abuse Assistance Pilot Program within DCF; creates "Jennifer Act"; authorizes adult with capacity to execute mental health or substance abuse treatment advance directive; establishes requirements for directive; provides circumstances under which directive may be revoked; provides circumstances under which principal may waive specific directive provisions without revoking directive; specifies conditions under which principal may be admitted for inpatient mental health or substance abuse treatment; requires express consent in directive for administration of psychotropic medication; requires conditions for administering such medication; prohibits principal from authorizing psychosurgery or electroconvulsive therapy in directive; provides for recognition of mental health & substance abuse treatment advanced directive executed in another state if it complies with laws of this state.
