Space and aerospace infrastructure.

Notwithstanding any other provisions of law, funds provided in Specific Appropriation 2649 of chapter 2008-152, Laws of Florida, for Space and Aerospace Infrastructure to make improvements to Launch Complex 36 on the 45th Space Wing property may also be used by Space Florida for improvements to other launch complexes and space transportation facilities in order to attract new space vehicle testing and launch business to the state; to address intermodal requirements and impacts of the launch ranges, spaceports, and other space transportation facilities; to advance aerospace technology to meet the current and future needs of the United States commercial space transportation industry; and to assist in the development of joint-use facilities and technology that support aviation and aerospace operations, including high-altitude and suborbital flights and range technology development.

A. Section 34, ch. 2010-153, provides that “[i]n order to implement Specific Appropriation 2672 and section 72 of the 2010-2011 General Appropriations Act, funds appropriated out of the Economic Development Transportation Trust Fund may be used for economic development infrastructure projects and other economic development projects; for improvements to other launch complexes and space transportation facilities in order to attract new space vehicle testing and launch business to the state; for addressing intermodal requirements and impacts of the launch ranges, spaceports, and other space transportation facilities; for advancing aerospace technology to meet the current and future needs of the United States commercial space transportation industry; and for assisting in the development of joint-use facilities and technology that support aviation and aerospace operations, including high altitude and suborbital flights and range technology development. This section expires July 1, 2011.”

B. Section 73, ch. 2010-153, provides that “[i]f any other act passed during the 2010 Regular Session contains a provision that is substantively the same as a provision in this act, but that removes or is otherwise not subject to the future repeal applied to such provision by this act, the Legislature intends that the provision in the other act takes precedence and continues to operate, notwithstanding the future repeal provided by this act.” Section 1, ch. 2010-222, and s. 3, ch. 2010-226, enacted s. 331.370 and did not include a repeal provision.

C. Section 48, ch. 2010-147, provides that “[t]he unexpended funds appropriated in Specific Appropriation 2649 of chapter 2008-152, Laws of Florida, for improvements to Launch Complex 36 on the 45th Space Wing property shall revert immediately and are reappropriated for state fiscal year 2010-2011 from the Economic Development Transportation Trust Fund for improvements to other launch complexes and space transportation facilities in order to attract new space vehicle testing and launch business to the state; to address intermodal requirements and impacts of the launch ranges, spaceports, and other space transportation facilities; to advance aerospace technology to meet the current and future needs of the United States commercial space transportation industry; and to assist in the development of joint-use facilities and technology that support aviation and aerospace operations, including high-altitude and suborbital flights and range technology development.”
