HB 1215: Property Insurance

GENERAL BILL by Trujillo

Property Insurance; Requires that before issuing homeowner's insurance policy, insurer must offer specified coverage options; revises requirements relating to offer for law & ordinance coverage; requires insurer to make certain sinkhole loss coverage available for additional premium; authorizes residential property insurance policies to include specified deductible amounts; revises definitions of terms "structural damage" & "safety hazard"; provides that insurer must pay initially to stabilize building if sinkhole loss is verified, subject to certain policy limits & terms; requires insurer to pay for certain repairs after completion of building stabilization in accordance with certain policy terms & limits; requires insured to repair sinkhole damage or loss in accordance with insurer's professional engineer's recommendation; deletes provision requiring insurer to pay for repairs in accordance with engineer's recommendation; subjects certain actions relating to stabilization & repairs to coverage limits & policy terms; revises provisions relating to payment of lienholders & other persons for stabilization & repairs; prohibits Citizens Property Insurance Corporation and insurers from nonrenewing property insurance policy under certain circumstances; provides for retroactive application under certain circumstances.
