HB 429: Motor Vehicle Manufacturers and Franchised Motor Vehicle Dealers

Motor Vehicle Manufacturers and Franchised Motor Vehicle Dealers; Prohibits applicant or licensee, or common entity thereof, from implementing certain criteria for measuring sales or service performance of franchised motor vehicle dealer; prohibits applicant or licensee, or common entity thereof, from implementing such criteria without first providing certain written information to franchised motor vehicle dealer; requires such information to be provided upon written request of motor vehicle dealer; prohibits applicant or licensee, or common entity thereof, from engaging in certain conduct not in good faith; revises conditions under which discontinuation, cancellation, or nonrenewal of franchise agreement is considered unfair; removes provisions relating to certain complaints made by certain motor vehicle dealer associations; authorizes motor vehicle dealer associations to maintain action for injunctive relief in name of DHSMV; specifies that certain violations are sufficient for issuance of injunction without establishing irreparable harm; authorizes motor vehicle dealer associations to seek adjudication for declaration & adjudication of its members' rights with respect to certain violations by applicant or licensee, or common entity thereof; authorizes motor vehicle dealers with certain standing to file written objection or notice of protest.
