HB 1337: Medical Liability/Claimant's Right

JOINT RESOLUTION by Troutman ; (CO-INTRODUCERS) Murzin

Medical Liability/Claimant's Right; constitutional amendment to provide that injured claimant who enters into contingency fee agreement with attorney in claim for medical liability is entitled to no less than 70 percent of first $250,000 of all damages received by claimant & 90 percent of all damages in excess of $250,000, exclusive of reasonable & customary costs & regardless of number of defendants; provides that amendment is self-executing. Creates s. 26, Art. I, s. 26, Art. XII.
