SB 2576: Competency to Proceed
GENERAL BILL by Haridopolos
Competency to Proceed; requires expert appointed to examine defendant to evaluate defendant with mental illness in facility of DOC when appropriate; requires defendant be returned to custody of DOC after charges against defendant are dismissed but defendant has active sentence with dept.; prohibits court from ordering conditional release if defendant with mental illness has active sentence with DOC, etc. Amends Chs. 916, 945, 922.07.
