GENERAL BILL by Eisnaugle ; (CO-INTRODUCERS) Ahern ; Horner

Commercial Mobile Radio Services; Creates "Wireless Anti-Fraud Act of 2012"; prohibits commercial mobile radio service carriers from adding charges to consumer accounts or collecting charges for third-party application providers that have not been expressly authorized by primary account holders; prohibits carriers from obtaining primary account holder's authorization through misleading or deceptive means or from imposing charges, collecting payments, or otherwise profiting from blocking consumer accounts from incurring charges from third-party application providers or receiving, handling, or processing consumer complaints or disputes; specifies procedures for providing notice to consumers of certain disclosures relating to charges for third-party applications, content, services, & other things & for obtaining primary account holder's authorization of charges; requires carriers to maintain certain documentation; provides procedures for consumer complaints or disputes & reversal of disputed charges; provides that violations are unfair & deceptive trade practices, which are subject to specified penalties & remedies; requires minimum award of damages.
