CS/CS/CS/HB 1379: Service of Process
GENERAL BILL by Judiciary Committee ; Justice Appropriations Subcommittee ; Civil Justice Subcommittee ; Mayfield
Service of Process; Requires sheriffs to charge uniform fee for service of process; requires employer to allow authorized individual to make service on employee in private area designated by employer; provides civil fine for employers failing to comply with process; revises provisions relating to substitute service if specified number of attempts of service made at business that is sole proprietorship; requires person requesting service or person authorized to serve process to file return-of-service form; revises provisions relating to service on corporation; provides that sheriff may rely on affidavit submitted by levying creditor; provides that sheriff may apply for instructions from court regarding distribution of proceeds from levy sale.
