CS/CS/HB 405: Garnishment

GENERAL BILL by Insurance and Banking Subcommittee ; Civil Justice Subcommittee ; Spano ; Grant

Garnishment; Revises "Notice to Defendant" provided by clerk of court in garnishment proceeding; provides that defendant in garnishment proceeding may provide notice of garnishment exemption & request for hearing to plaintiff's or garnishee's attorney; extends time allowed for plaintiff or plaintiff's attorney to respond to defendant's claim of exemption & request for hearing; provides response procedures of clerk of court & plaintiff's attorney when plaintiff's attorney is served with notice of garnishment exemption & request for hearing; requires defendant to certify under oath & penalty of perjury that he or she provided notice of garnishment exemption claim & request for hearing to plaintiff, garnishee, or their respective attorneys in order to obtain hearing; repeals provisions relating to proceedings for exemption.
