GENERAL BILL by Campbell
Guardians and Wards; Provides that guardian or attorney is entitled to reasonable fee for services and costs if there is proven benefit to ward by actions of guardian or attorney; revises criteria for award of fees for guardian or attorney; prohibits fee awards when conflict of interest exists; revises what fees for legal services may include; revises requirements for petitions for guardian & attorney fees; revises requirements for composition & appointment of examining committee; revises requirements for examinations & reports; allows family members & caregivers to observe & record evaluations; requires that court dismiss petition if an examining committee member concludes that person is not incapacitated; revises provisions on rulings on petitions for guardianship; revises provisions relating to suspension of trust, trust amendment, or durable power of attorney in certain circumstances; prohibits financial exploitation of ward; provides for forfeiture of personal property used in connection with financial exploitation of ward.
