CS/HB 853: Housing Discrimination

GENERAL BILL by Civil Justice and Claims Subcommittee ; Davis ; (CO-INTRODUCERS) Peters ; Shaw

Housing Discrimination; Removes housing discrimination as cause of action for certain relief & damages stemming from violations of Florida Civil Rights Act of 1992; revises conditions under which aggrieved person may commence civil action in appropriate court against specified respondent to enforce specified rights; provides that aggrieved person does not need to take specified actions before bringing civil action; authorizes, rather than requires, civil action to commence within 2 years after alleged discriminatory housing practice; authorizes aggrieved person to commence civil action regardless of whether specified complaint has been filed & regardless of status of any such complaint; prohibits aggrieved person from filing specified action in certain circumstances; prohibits aggrieved person from commencing specified civil action if an administrative law judge has commenced hearing on record on allegation.
