Agreements with Federal Government for the preservation of saltwater fisheries; authority of department.
370.103 Agreements with Federal Government for the preservation of saltwater fisheries; authority of department.--The Department of Environmental Protection is authorized and empowered to enter into cooperative agreements with the Federal Government or agencies thereof for the purpose of preserving saltwater fisheries within and without state waters and for the purpose of protecting against overfishing, waste, depletion, or any abuse whatsoever. Such authority includes the authority to enter into cooperative agreements whereby the Division of Law Enforcement of the department is empowered to enforce federal statutes and rules pertaining to fisheries management. When differences between state and federal laws occur, state laws shall take precedence.
