SECTION 956
Applicability and certification.

403.956  Applicability and certification.--

(1)  The provisions of this act shall apply to any projects as defined herein.

(2)  At the option of the applicant, any project found by the 1Department of Commerce to be eligible under the criteria of s. 403.953 may utilize the procedures of this part to obtain agency licenses necessary to facilitate the location of the project in the State of Florida.

(3)  Nothing in this part shall be construed to require any eligible project to utilize the procedures of this part in lieu of ordinary agency permit procedures prescribed by law.

(4)  Nothing in this part shall create a presumption that a proposed project should be certified.

(5)  No project authorized to utilize other siting acts in this chapter or chapter 341 shall be sited using the procedures of this part.
