Assignment of administrative law judge.

403.960  Assignment of administrative law judge.--

(1)  Within 7 days after an application has been declared sufficient or an applicant has requested that its application be processed on the basis of information already submitted, the 1Department of Commerce shall request the director of the Division of Administrative Hearings to assign an administrative law judge for all proceedings necessary under this act with respect to the application. A copy of the certification application shall accompany the request. The Division of Administrative Hearings shall assign an administrative law judge within 7 days after receiving the request from the 1Department of Commerce. In assigning an administrative law judge, the director shall, whenever practicable, assign an administrative law judge with prior experience in site certification proceedings under this chapter.

(2)  Within 7 days after receiving a copy of the certification application, the Division of Administrative Hearings shall issue a notification to affected agencies that the application is pending before the division.
