SB 138: Criminal Street Gang Activity

Criminal Street Gang Activity; revises procedure under which court may sentence person to enhanced sentence when person is convicted of or adjudicated delinquent for committing offense for purpose of benefiting, promoting, or furthering interests of criminal street gang; deletes requirement that court make such finding at sentencing; deletes requirement that such finding be made by preponderance of evidence, etc. Amends 874.04; reenacts 921.0024(1)(b).
