SECTION 1135
Underground utility and excavation contractors; designation; certificate.

489.1135  Underground utility and excavation contractors; designation; certificate.--

(1)  Each business entity which at the time of application is not qualified by a construction contractor licensed pursuant to s. 489.105(3)(n), and is qualified by the Department of Transportation as of January 1, 1993, in both the "grading" and "drainage" classes established in rule pursuant to s. 337.14, may designate one person for certification as an underground utility and excavation contractor, providing that person:

(a)  Has at least 5 years' experience in grading and drainage work, at least 2 years of which must have been in a supervisory capacity with the qualified business entity.

(b)  Is at least 18 years of age.

(c)  Is an employee of, or has an ownership interest in, that business entity.

(2)  The board shall issue, without examination, a certificate in the category of underground utility and excavation to an applicant properly designated pursuant to subsection (1), provided the board has received a completed application, including an application fee of $150 and a certification fee of $125, from such applicant prior to April 1, 1994, and provided the applicant:

(a)  Has not had a registration or certificate which was issued by the board suspended, revoked, or relinquished or deposited in lieu of further disciplinary action.

(b)  Does not have a disciplinary case pending before the board, or the Department of Transportation.

(c)  Has not been convicted of a crime in any jurisdiction which directly related to the practice of contracting or the ability to practice contracting.
