Uniform waterway regulatory markers.

327.41  Uniform waterway regulatory markers.--

(1)  The Fish and Wildlife Conservation Commission shall adopt rules and regulations pursuant to chapter 120 establishing a uniform system of regulatory markers for the Florida Intracoastal Waterway, compatible with the system of regulatory markers prescribed by the United States Coast Guard, and shall give due regard to the System of Uniform Waterway Markers approved by the Advisory Panel of State Officials to the Merchant Marine Council, United States Coast Guard.

(2)  Any county or municipality which has been granted a restricted area designation, pursuant to s. 327.46, for a portion of the Florida Intracoastal Waterway within its jurisdiction may apply to the Fish and Wildlife Conservation Commission for permission to place regulatory markers within the restricted area.

(3)  Application for placing regulatory markers on the Florida Intracoastal Waterway shall be made to the 1Division of Marine Resources, accompanied by a map locating the approximate placement of the markers, a statement of the specification of the markers, a statement of purpose of the markers, and a statement of the city or county responsible for the placement and upkeep of the markers.

(4)  No person or municipality, county, or other governmental entity shall place any regulatory markers in, on, or over the Florida Intracoastal Waterway without a permit from the 1Division of Marine Resources.

(5)  Aquaculture leaseholds shall be marked as required by this section, and the commission may approve alternative marking requirements as a condition of the lease pursuant to s. 253.68. The provisions of this section notwithstanding, no permit shall be required for the placement of markers required by such a lease.

(6)  The commission is authorized to adopt rules pursuant to chapter 120 to implement the provisions of this section.
