Duration of suspension; insurer's obligations during suspension period; reinstatement.

624.421  Duration of suspension; insurer's obligations during suspension period; reinstatement.--

(1)  Suspension of an insurer's certificate of authority shall be for:

(a)  A fixed period of time not to exceed 2 years; or

(b)  Until the occurrence of a specific event necessary for remedying the reasons for suspension.

Such suspension may be modified, rescinded, or reversed.

(2)  During the period of suspension, the insurer shall file with the department all documents and information and pay all license fees and taxes as required under this code as if the certificate had continued in full force.

(3)  If the suspension of the certificate of authority is for a fixed period of time and the certificate of authority has not been otherwise terminated, upon expiration of the suspension period the insurer's certificate of authority shall be reinstated unless the department finds that the insurer is not in compliance with the requirements of this code. The department shall promptly notify the insurer of such reinstatement, and the insurer shall not consider its certificate of authority reinstated until so notified by the department. If not reinstated, the certificate of authority shall be deemed to have expired as of the end of the suspension period or upon failure of the insurer to continue the certificate during the suspension period in accordance with subsection (2), whichever event first occurs.

(4)  If the suspension of the certificate of authority was until the occurrence of a specific event or events and the certificate of authority has not been otherwise terminated, upon the presentation of evidence satisfactory to the department that the specific event or events have occurred, the insurer's certificate of authority shall be reinstated unless the department finds that the insurer is otherwise not in compliance with the requirements of this code. The department shall promptly notify the insurer of such reinstatement, and the insurer shall not consider its certificate of authority reinstated until so notified by the department. If satisfactory evidence as to the occurrence of the specific event or events has not been presented to the department within 2 years of the date of such suspension, the certificate of authority shall be deemed to have expired as of 2 years from the date of suspension or upon failure of the insurer to continue the certificate during the suspension period in accordance with subsection (2), whichever first occurs.

(5)  Upon reinstatement of the insurer's certificate of authority, the authority of its agents in this state to represent the insurer shall likewise reinstate. The department shall promptly notify the insurer of such reinstatement.
