GENERAL BILL by Appropriations ; Judiciary ; Health, Aging, and Long-Term Care ; Saunders ; Peaden

Medical Malpractice; (THIS BILL COMBINES CS/CS/S564,2120,2620) revises requirements for set offs against damages in medical malpractice actions if there is written release or covenant not to sue; revises requirements for presuit notice & insurer or self-insurer response to claim; requires claimant to execute medical release to authorize defendants in medical negligence actions to take unsworn statements from claimant's treating physicians, etc. Amends FS.

Effective Date: 07/01/2003 except as otherwise provided
