CS/HB 349: Treatment Programs for Impaired Licensees and Applicants

GENERAL BILL by Health Quality Subcommittee ; Renuart ; (CO-INTRODUCERS) Campbell

Treatment Programs for Impaired Licensees and Applicants; Exempts entity retained by DOH as impaired practitioner consultant from certain licensure requirements; authorizes impaired practitioner consultants to contract with schools or programs to provide services to impaired students who are enrolled for preparing for licensure as specified health care practitioner or as veterinarian; limiting liability of those schools or programs; provides that impaired practitioner consultant is official custodian of records relating to referral of licensee or applicant to consultant & other interaction between them; clarifies circumstances under which impaired practitioner consultant may disclose certain information concerning impaired licensee or applicant; authorizes DOH & others that contract with impaired practitioner consultant to have administrative control over consultant to receive disclosures allowed under federal law; authorizes impaired licensee or applicant to obtain confidential information from DOH regarding pending disciplinary proceeding; provides that radiological personnel are subject to treatment program for impaired licensees.
