255.551  Definitions; ss. 255.551-255.565.--As used in ss. 255.551-255.565:

(1)  "Abatement" means the removal, encapsulation, or enclosure of asbestos, but does not include the removal of bituminous resinous roofing systems or the removal of resilient floor covering and its adhesive in accordance with the licensing exemption in s. 469.002(3).

(2)  "Asbestos" means the asbestiform varieties of chrysotile, crocidolite, amosite, anthophyllite, tremolite, and actinolite, but does not include bituminous resinous roofing products.

(3)  "Asbestos consultant" means a person who conducts surveys for asbestos-containing materials and performs related tasks.

(4)  "Asbestos contractor" means a person who engages in the business of removing, encapsulating, and enclosing asbestos-containing materials and disposing of asbestos waste.

(5)  "Asbestos surveyor" means a person who works under the direction of a licensed asbestos consultant and engages in the survey and assessment of asbestos-containing materials. This term means the same as inspector under AHERA.

(6)  "Management planner" means a person who works under the direction of a licensed asbestos consultant and engages in the development of asbestos abatement schedules and operation and maintenance plans.

(7)  "Project monitor" means a person who works under the direction of a licensed asbestos consultant and engages in monitoring and evaluating the abatement of asbestos-containing materials.

(8)  "Asbestos-containing materials" means any materials which contain more than 1 percent asbestos by weight.

(9)  "Encapsulation" means the application of a coating to friable asbestos to prevent fiber release.

(10)  "Enclosure" means the construction of an airtight barrier around friable asbestos to prevent fiber release.

(11)  "Friable" means the condition of any asbestos-containing materials which, when dry, may be crumbled or reduced to powder by hand pressure.

(12)  "Small-scale short duration" means the installation, removal, repair, encapsulation, or enclosure of 12 square feet or less of asbestos-containing materials or 12 linear feet or less of asbestos-containing material.

(13)  "Operation and maintenance plan" means a set of procedures undertaken to clean up previously released asbestos fibers, prevent future release of fibers by minimizing disturbance or damage to asbestos-containing materials, and monitor the condition of the asbestos-containing materials.

(14)  "Public building" means any building owned by any state agency.

(15)  "AHERA" means the Asbestos Hazard Emergency Response Act of 1986, and any rules adopted thereunder.

(16)  "Response action" means a method including removal, encapsulation, enclosure, repair, operations, and maintenance that protects human health and the environment from friable asbestos-containing material.
