Statewide cleanup of perfluoroalkyl and polyfluoroalkyl substances.
A. Section 84, ch. 2025-199, amended paragraph (2)(a) “[i]n order to implement section 171 of the 2025-2026 General Appropriations Act.”
B. Section 85, ch. 2025-199, provides that “[t]he amendments to s. 376.91(2)(a), Florida Statutes, made by this act expire July 1, 2026, and the text of that paragraph shall revert to that in existence on June 30, 2025, except that any amendments to such text enacted other than by this act shall be preserved and continue to operate to the extent that such amendments are not dependent upon the portions of text which expire pursuant to this section.” Effective July 1, 2026, paragraph (2)(a), as amended by s. 85, ch. 2025-199, will read:
(a) If the United States Environmental Protection Agency has not finalized its standards for PFAS in drinking water, groundwater, and soil by January 1, 2025, the department shall adopt by rule statewide cleanup target levels for PFAS in drinking water, groundwater, and soil using criteria set forth in s. 376.30701, with priority given to PFOA and PFOS. The rules for statewide cleanup target levels may not take effect until ratified by the Legislature.
